Oxfam Lottery terms and conditions

Effective from: 29 January 2024

1.Introduction

1.1 The Oxfam Lottery ("the Lottery") will be operated as a Society Lottery under the Gambling Act 2005, as amended ("the Act") and subsidiary legislation, as amended and the Promoter, Oxfam GB, is licensed and regulated in Great Britain by The Gambling Commission under account number 46163. Oxfam GB holds society Lottery operating licence(s) number(s) 000-046163-N-324573 and 000- 046163-R-324572. The Oxfam Lottery is operated by Sterling Management Centre Ltd an External Lottery Manager licensed and regulated in Great Britain by The Gambling Commission under account number 3137.

1.2 The Lottery is promoted by the Promoter and conducted for the benefit of Oxfam's work. In financial year 2023/24, proceeds from the Oxfam Lottery were £425,343. Of that, 69% (£293,296) was spent on fighting global poverty, 20% (£83,550) on prizes and 11% (£48,557) on expenses.

1.3 The people responsible for the promotion of the Lottery are Jan Oldfield and Lorna Fallon.

1.4 By entering the Lottery, Players agree to be bound by these rules. If you do not so agree, you should not play the Lottery.

1.5 The Lottery is operated in line with Oxfam's Fundraising Policy.

2. Definitions

"Chance" An entry into the Lottery.

"Draw" The process by which winners are selected.

"Game Number" The unique number associated with each Chance, and which is used to determine the winners.

"Legislation" The Gambling Act 2005 and successor and amendment legislation thereto, together with subsidiary legislation thereunder and successor and amendment legislation thereto.

"Lottery" The Oxfam Lottery.

"Player" An individual who takes part in the Oxfam Lottery.

"Promoter" Oxfam GB, a registered charity in England and Wales (no.202918) and Scotland (SC039042).

"Rules" The rules of the Oxfam Lottery as set out below and amended from time to time.

“Single Entry Chances” means one off Chances purchased in Oxfam shops.

“Subscription” means a monthly direct debit set up by the Player in order to play the Oxfam lottery on an ongoing basis.

2.1 Entry into the Oxfam Lottery

The Lottery is promoted in accordance with the Legislation. In order to comply with the Legislation, when you purchase any Chance you will be required to confirm that:

  • (a) You are aged 18 or over;
  • (b) You are resident in the United Kingdom (due to Gambling Commission regulations, this excludes the Isle of Man, Channel Islands and BFPO addresses).

You must also not buy, nor attempt to buy, Chances on behalf of any other person.

2.2 If, upon winning any prize in the Lottery, you are not able to prove upon request that you have met the criteria specified in Rules 2.1 (a) and (b) above then you will not be entitled to receive any prize.

2.3 In order to comply with the Legislation, any Chances that have been purchased and entered into the Draw for which they were intended are prohibited from being subsequently refunded.

2.4 By entering into the Lottery you agree to be bound by the Rules, and all applicable provisions of the Legislation. Oxfam shall not be liable for any loss or damage (including loss of the opportunity to enter the Lottery and / or the right to receive a prize) suffered by you if you have not complied with the Rules. The Rules may be amended by Oxfam from time to time. You will be notified of any material changes before they take effect by email, or via information displayed in participating Oxfam shops.

2.5 This Lottery is a form of gambling. Participants are encouraged to gamble responsibly. Should gambling become a problem we recommend you contact the GambleAware helpline on 0808 8020 133 or visit their website on www.gambleaware.co.uk

2.6 The maximum number of entries an individual will be permitted to purchase in any one transaction is 10 (ten).

2.7 In order to comply with the Legislation only those Chances for which payment has been received are eligible for entry into the Draw.

2.8 Entry into the Oxfam Lottery is permitted for Oxfam volunteers and employees, other than those directly involved in running of the lottery.

2.9 Entry into the Oxfam Lottery is available either by Subscription or by Single Entry Chances.

3. Registration with the Lottery (only applicable to Subscription based Players)

3.1 You can only enter the Lottery upon completing an application form which will be published in a variety of forms from time to time.

3.2 Subscription based entry is by Direct Debit.

3.3 Registration will require you to provide the following information:

  • (a) Your name, postal address and email address, so that we can contact you to confirm your entry into the Lottery and contact you if you have won a prize;
  • (b) Confirmation that you are over 18 years of age, in order to ensure compliance with the Act; and
  • (c) The number of Chances in the Lottery you wish to purchase

3.4 You will also be asked to provide the following information:

  • (a) Your date of birth;
  • (b) Your postal address;
  • (c) Your e-mail address; and
  • (d) Your contact telephone number
  • (e) In relation to your Direct Debit, the information required will include your bank or building society details together with an instruction to such bank or building society to make payments by Direct Debit.

3.5 Oxfam shall be entitled to take any steps necessary to verify the above information and to process your registration. Oxfam may (in its absolute discretion) refuse to accept an application for an individual to become a Player of the Lottery.

3.6 Following registration Oxfam will send you confirmation of your entry. If you have chosen to pay by Direct Debit you will receive an Advance Notification email. The confirmation will specify your Game Number and the first draw into which you will be entered and will confirm your name, address and any other details provided to Oxfam as part of your registration.

3.7 It is your responsibility to ensure that the personal information you provide to us is accurate.

3.8 If you discover any error in your name, address or any other details provided to Oxfam as part of your registration when you receive your confirmation, then you must correct this by notifying Oxfam in writing or by e-mail to Lottery@oxfam.org.uk. Oxfam will make any required corrections as soon as reasonably possible. Oxfam shall not be liable for any loss or damage (including loss of the opportunity to enter the Lottery and / or the right to receive a prize) suffered by you until such correction has been made. Any correction notified to Oxfam shall only become effective once the correction has been made.

3.9 Each Game Number is unique. A randomly selected Game Number will be issued to you with your confirmation of entry.

4. Payment

4.1 Payment for Chances may be made by the following methods:

  • (a) Direct Debit (Subscription based players only)
  • (b) Cash, debit card and credit card are accepted for Single Entry Chances purchased in Oxfam shops (see section 8 for more information about Single Entry Chances).
  • (c) Any other method made available by Oxfam from time to time.

4.2 Payment for Chances are made directly to Oxfam.

  • (a) Direct Debit payments will generally be referenced as 'Oxfam Lot123456' (with the numbers denoting a reference number) on your bank statement (although this may vary as the reference is determined by your bank, and may quote 'Sterling Management' who administer the lottery on behalf of Oxfam).
  • (b) Any other method made available by Oxfam from time to time would also be referenced as or be payable to Oxfam on any appropriate documentation.

4.3 Direct debits are collected once monthly. The price for each Chance is £1. Playing the Lottery by means of a Direct Debit subscription incurs a monthly payment of £4.34, which works out at £52.08 per year, and will enter you into 52 weekly Draws. The exception to this could be where there are 5 Draws in a month within the first few months of your joining the Lottery. In this scenario, you may not be entered into the fifth Draw in that particular month, as you may not have accrued sufficient credit to cover the cost of entry. After this point, you should have built up sufficient credit to be entered into future Draws.

4.4 Your Chances and therefore associated Game Number(s) will not be entered into the Draw unless Oxfam GB has received all amounts payable (cleared funds) relating to your Game Numbers for that week's draw. If there is a dispute regarding whether Chances have been paid for then such dispute shall be resolved by reference to details included in official statements from the bank with which the Lottery's bank accounts operate.

4.5 Details of your Direct Debit will be in your welcome pack, along with information on how to amend your Direct Debit. You will be notified of your first Draw date in writing.

4.6 You may cancel your Direct Debit entry into the Lottery by notifying Oxfam in writing or by e-mail (or via any other methods specified by Oxfam from time to time). Upon receipt of this notice Oxfam will:

  • (a) Cancel future Direct Debit payments as soon as is reasonably practicable; and
  • (b) In accordance with the Legislation and as described in Rule 2.3 any payments made prior to such cancellation taking effect but which have not been used to pay for Chances in previous Draws will be used to pay for entry for your Chances into future Draws.

4.7 Oxfam may cancel your entry into the Lottery (in its absolute discretion) at any time. Oxfam will notify you accordingly as soon as reasonably practicable and will reimburse any amounts which have been paid but relate to future Draws. Other than the reimbursement of any such amounts, Oxfam shall not be liable for any loss or damage (including loss of the opportunity to enter the Lottery and / or the right to receive a prize) suffered by you in relation to such cancellation.

4.8 All customer funds for use in future Lottery entries paid to the Lottery are held in a separate bank account with trustee status to maintain a separation from Oxfam's own trading income to protect those funds in the event of insolvency. 5. Changes to Player Details (Subscription based Players only)

5.1 Any changes to your details as provided by you upon registration should be notified to Oxfam in writing or by e-mail. Changes to the bank or building society specified during registration will require the completion of a new Direct Debit Instruction. Further information regarding this can be obtained from Oxfam upon request.

6. Draws

6.1 A Lottery draw will take place every Friday, except when a Friday falls on a bank holiday in England and then the draw will take place on the next working day in England.

6.2 The Draw will be conducted at our External Lottery Manager's offices and determined by means of a random number generator which has been certified by a Gambling Commission approved test house.

7. Prizes

7.1 Prizes are issued as follows:

  • (a) First Prize £1,000 weekly
  • (b) Second Prize £100 weekly
  • (c) Third prize £50 weekly
  • (d) Fourth prize 2 x £25 weekly
  • (e) Fifth prize 25 x £10 weekly
  • (f) Sixth prize 70 x £5 weekly
  • (g) Superdraw £5000 bi-annually (twice a year)

7.2 Oxfam reserves the right to amend the value and quantity of prizes at any time. Any such changes will be published on the Oxfam Website at least one month prior to a change being made. All Players will be notified of material changes to the prizes either by email or by notices displayed in participating Oxfam shops.

7.3 Payment of prizes for winners who subscribe by Direct Debit is by direct credit to your bank account. This will be the same account as the one used for payment of Chances.

7.4 Each Game Number shall only be entitled to win one prize in one Draw. Based on the number of lottery entries in the year ending 31 March 2024, each entry has a roughly 1 in 74 chance of winning a prize.

7.5 Where winning entries were bought in an Oxfam shop, then prizes will be paid either immediately following receipt of a valid claim in an Oxfam shop (applies to £5 and £10 prizes only) or within 90 days of receipt by us of a valid claim made online at https://oxfam.charitypayments.co.uk/prize-claim Please see paragraph 8.3 for additional information regarding tickets bought in Oxfam shops.

7.6 The results of each Draw will be published on the Oxfam GB website within one week of the date of the draw and may also be published in any other manner determined by Oxfam from time to time.

7.7 Winners who play by Direct Debit will be notified by email, phone or post within one week of the date of the draw.

7.8 Oxfam reserves the right to withhold the payment of any prize until it is entirely satisfied that the Player who has won the prize has fully complied with the Rules and has established that they are of legal age to participate.

7.9 There are no alternatives to the prizes offered from time to time and no interest is payable.

7.10 By accepting the prize, each winner agrees that Oxfam has the right to use their first name and location for promotional purposes (for example Clare, Luton). We may also ask permission to use their photograph and audio/visual recordings of them in our publicity, but will always seek the consent of the winner before doing so.

8. Single Entry Chances

8.1 Single Entry Chances can be purchased in participating Oxfam shops, up to a maximum of 10 tickets. There are 2 types of Single Entry ticket:

8.2 You can purchase up to 10 Single Entry Chances at a time for standard weekly draws, provided at least one entry is for the next available Lottery draw as well as at least one entry in each subsequent draw, up to a maximum of ten entries overall, and also provided that the same number of tickets are purchased for each draw, OR;

You can purchase up to 10 tickets for the next scheduled Superdraw, dates for which will be advertised around 4 weeks prior to the date of the Superdraw.

8.3 Tickets bought in Oxfam shops will be provided in the form of a till receipt at the point of purchase. It is the Player’s responsibility to check at the point of purchase that the information on the ticket is readable and to request a replacement if it is not. The Player is required to keep tickets safe and in good condition. Oxfam cannot reissue tickets once the Player has left the till. Players will be required to present their ticket at the till of any participating Oxfam shop to claim their prize.

8.4 In exceptional circumstances, where you have a valid reason for purchasing a greater number of Chances than set out in 8.1 (such as to use as wedding favours or similar gifts) the Promoter may in its absolute discretion agree to increase the maximum number to 100. Any request to purchase more than 10 Single Entry Chances should be referred to the relevant Oxfam shop manager.

8.5 Players purchasing Single Entry Chances can check if they have won a prize either by entering their ticket number into the following web page - https://www.oxfamapps.org.uk/lottery-winners/ or by presenting their ticket at the till in a participating Oxfam store.

8.6 To claim a prize on a winning ticket bought in an Oxfam shop:

  • 8.6.1 for £5 and £10 prizes only, a Player may claim their winnings in an Oxfam shop. You will need to present your ticket at the till. If your claim is valid, Oxfam will either transfer your prize into your bank account or where you paid for your ticket in cash, will pay your prize in cash. Alternatively, the prize may be used as part payment for goods bought instore. You will then receive a ‘win receipt’ confirming the pay-out; or
  • 8.6.2 for any prize value, you may claim online using the web form available at https://oxfam.charitypayments.co.uk/prize-claim. We will use the information provided to enter the Lottery and claim a prize, to contact you in connection with your claim and to award your prize.

8.7 Claims must be received within 90 days of the draw. Any prizes not claimed within this timeframe will be gratefully accepted as a donation to Oxfam.

9. Suspension of the Lottery

9.1 Oxfam may (at its absolute discretion) suspend the Lottery for any period of time. During any such period, Oxfam shall, as soon as is reasonably practicable:

  • (a) Suspend Direct Debit payments from the player's bank or building society account, and;
  • (b) Suspend sales of Single Entry Chances in Oxfam shops, and;
  • (c) Retain any amounts which were paid prior to such suspension taking effect that have not been used to pay for Chances in previous Draws.

You will be notified of further details regarding the resumption of the Lottery or otherwise as soon as reasonably practicable after the date of suspension in writing.

10. Liability

10.1 Oxfam shall not be liable to you for any loss or damage suffered by you arising from:

  • (a) Any delays or failures in the postal service or other delivery methods used by Oxfam or you from time to time.
  • (b) Any delays or failures in any systems used by Oxfam or you to transmit e-mails.
  • (c) Any failure in any software or other systems used by Oxfam for the administration of the Lottery.
  • (d) Any delays or failures in the banking system used by Oxfam or you.
  • (e) Any refusal by Oxfam to accept registration of an individual as a Player or the cancellation of a Player by Oxfam
  • (f) Any failure to enter your Chance into the Draw.
  • (g) Any event beyond the reasonable control of Oxfam.

10.2 Oxfam shall not be liable to you in contract, tort, negligence or otherwise for any indirect or consequential loss suffered by you in relation to your participation in the Lottery (including loss of the opportunity to enter the Lottery and / or the chance of winning a prize).

11. Self-Exclusion

11.1 Should you feel that you have issues with gambling and wish to be self-excluded from our Lottery please complete and return a self-exclusion request form or phone our helpline number (0370 058 5944).

11.2 There is a minimum period of 6 months self-exclusion and a maximum of 5 years.

11.3 We will not target you with any marketing material during the self-exclusion period and will opt you out of all communications indefinitely on any marketing databases used by ourselves.

11.4 You will need to contact us after your period of self-exclusion to take positive action to re- instate your participation in the Lottery.

12. Complaints

12.1 Any complaints relating to the Lottery should be sent in writing to Oxfam at the address below, giving full details of the complaint and supporting documentation.

12.2 All complaints will be dealt with in accordance with Oxfam's lottery complaints and disputes procedure, a copy of which is available upon request, or upon making a complaint.

12.3 The Promoter's decisions made pursuant to the complaints and disputes procedure shall be final and binding.

12.4 Save where the Rules expressly provide otherwise, the Promoter shall not be obliged to enter into any correspondence.

12.5 All complaints related to the Lottery will be recorded by Oxfam.

13. Privacy

13.1 Oxfam is committed to protecting your privacy, as described in our Privacy Policy. Data that we collect from you is processed lawfully in accordance with the Data Protection Act 2018 and is used solely for the purpose of processing your purchase of Chances, subsequent entry into the Lottery, and informing you if you have won a prize or have explicitly opted in to receive marketing communications from Oxfam.

13.2 You have the right to access the information we hold about you. To obtain this information, please contact Oxfam in writing. You may be asked to provide proof of your identity prior to personal information being disclosed to you.

13.3 Oxfam will not sell, rent or grant access to any of the personal data we collect about you to any third parties without your express prior permission.

13.4 We may share aggregated information to third parties. This will not contain personal information that can identify any individual person.

13.5 We may be obliged to disclose your personal information if required to do so by law, for example to statutory bodies such as the Gambling Commission or other government bodies.

14. Applicable Law and Jurisdiction

14.1 The law of England and Wales shall govern the interpretation and/or enforcement of these Rules and Oxfam and all entrants hereby submit to the exclusive jurisdiction of the courts of England and Wales.
